These Terms and Conditions govern the use of the valensiamoda.it website and the purchase of products offered by Valensia di John Sebastian Valencia Garcia. By accessing the site or placing an order, you fully accept the following.

1. Who we are

The site is operated by Valensia di John Sebastian Valencia Garcia, based at Via Colli dei Longobardi 79, 25020 Capriano del Colle (Brescia), Italy. For any query you can write to us at info@valensiamoda.it.

2. Purpose

These Terms govern the distance sale, through the site, of Valensia Moda clothing and accessories to consumers and, where applicable, to business buyers. The essential characteristics of the products are set out on the relevant product pages.

3. Orders and formation of the contract

The order is considered concluded when you receive our confirmation email. Before confirming your purchase you will always be able to review the order summary and correct any mistakes. We reserve the right not to accept an order in the event of product unavailability, inconsistencies in the data provided, or well-founded suspicion of fraud, and we will notify you of this by email.

4. Prices and payment

Prices shown on the site are in euros and include VAT. Any shipping costs are shown separately before the order is confirmed. Payment can be made using the methods offered at checkout (including credit/debit cards, PayPal, Shop Pay, Apple Pay, Google Pay and, where available, instalment payment through Klarna); these are processed by the respective payment providers.

5. Shipping and delivery

Shipping methods, timeframes and costs are shown at checkout and may vary depending on the destination. Risk of loss or damage to the products passes to the buyer upon delivery.

6. Right of withdrawal and returns

If you are purchasing as a consumer, you have the right to withdraw from the contract in accordance with the terms set out in our Refund and Returns Policy, which forms an integral part of these Terms.

7. Statutory warranty of conformity

The products sold are covered by the statutory warranty of conformity provided for under the Italian Consumer Code, for goods that show a lack of conformity already present at the time of delivery. To claim under this warranty, please contact us at the address given in section 1.

8. Intellectual property

The Valensia name, logo, exclusive prints and any other content on the site (text, images, graphics) are the property of Valensia or its licensors and are protected under copyright and industrial property law. Reproduction, in whole or in part, is not permitted without written authorisation.

9. Liability

We work to keep the site accurate and functioning, but we cannot guarantee it will be entirely free of errors or interruptions. To the extent permitted by law, we are not liable for indirect damages arising from the use of the site, without prejudice to the statutory warranty of conformity and to any mandatory consumer protection rules.

10. Personal data and cookies

The processing of personal data collected through the site is governed by our Privacy Policy, while the use of cookies and similar technologies is described in our Cookie Policy.

11. Changes to these Terms

We reserve the right to update these Terms at any time; the version that applies is the one published on the site at the time you place your order. Changes do not have retroactive effect on orders already confirmed.

12. Governing law and jurisdiction

These Terms are governed by Italian law. For consumers, the mandatory rules of their country of residence remain applicable where more favourable, and the competent court is that of the consumer's place of residence or domicile, if located in Italy. In the event of a dispute, you can also turn to the European Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
