Refund and Return Policy

RIGHT OF WITHDRAWAL

1. Pursuant to Legislative Decree 06/09/05 No. 206, the consumer client has the right to withdraw from the purchase contract for any reason, without needing to provide explanations and without any penalty, within 15 days from the delivery of the products.
   To exercise this right, the client must send written communication by registered letter with acknowledgment of receipt to  Valensia Di John Sebastian Valencia, or to the email address info@valensiamoda.it indicating the product or products for which they intend to exercise the Right of Withdrawal, provided they are intact.
   Once the aforementioned withdrawal communication is received,  Valensia Di John Sebastian Valencia will promptly communicate to the client the instructions on how to return the goods.
2. The right of withdrawal is in any case subject to the following conditions:
   1. the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
   2. The purchased good must be intact;
   3. The right of withdrawal does not apply to personalized products.
3. By law, the shipping costs related to the return of the goods are borne by the client. The shipment, until the certified receipt at our warehouse, is under the complete responsibility of the client. In case of damage to the goods during transport,  Valensia Di John Sebastian Valencia will notify the client of the incident, to allow them to promptly file a complaint against the courier they chose and obtain reimbursement of the value of the goods (if insured); in this event, the product will be made available to the client for its return, simultaneously canceling the withdrawal request.
   Valensia Di John Sebastian Valencia is in no way responsible for damage or theft/loss of goods returned with uninsured shipments.
   Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and/or the original wrapping are damaged,  Valensia Di John Sebastian Valencia will retain a percentage from the due refund, in any case not exceeding 20% of the same, as a contribution to restoration costs.  If the product has been opened with seals broken, the product will not be refunded.
4. Without prejudice to any restoration costs for ascertained damage to the original packaging, Valensia Di John Sebastian Valencia will reimburse the client the full amount already paid, within 30 days of the return of the goods, through a reversal procedure of the amount charged to the PayPal account used or by bank transfer. In the latter case, the client will be responsible for promptly providing the bank details to which the reimbursement should be made (full IBAN code).
5. The right of withdrawal lapses completely, due to the lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where Valensia Di John Sebastian Valencia ascertains:
   1. the absence of the outer packaging and/or the original inner packaging;
   2. the absence of integral elements of the product;
   3. damage to the product for reasons other than its transport.
6. In the event of the lapse of the right of withdrawal, Valensia Di John Sebastian Valencia will return the purchased goods to the sender, charging the sender the shipping costs.

Exclusion of the Right of Withdrawal for tailor-made or personalized products; pursuant to Legislative Decree No. 185/99 – art. 5 paragraph 3c, the consumer cannot exercise the right of withdrawal for contracts for the supply of goods manufactured to measure or clearly personalized.
